END USER LICENSE AGREEMENT

This End User License Agreement (hereinafter referred to as the "Agreement") is a legally binding contract between you (as an individual or a legal entity) and Effectico OÜ, registered in Estonia under registration number 16250064 (hereinafter referred to as "Effectico," "we," "us," or "our"), which sets forth the terms and conditions for using the NeutrinoParticles Editor software and https://neutrinoparticles.com/ website (hereinafter referred to as the "Software").
1. Acceptance of Terms
By installing, copying, or otherwise using the Software, you agree to comply with the terms of this Agreement. If you do not agree with the terms of this Agreement, do not install or use the Software.
2. Use of the Website and Software
2.1 Free Download: The editor can be downloaded from the website for free. It can be used to create and view effects within the editor.
2.2 Export of Effects: To insert an effect into a game or use it on a web page, the user must export the effect. To do this, the user must register on the website by providing their email, login, and password.
3. Intellectual Property Rights
The Software is distributed under general copyright rules. All rights, including copyrights and trademark rights, belong to Effectico OÜ. Copying, modifying, distributing, or creating derivative works based on the Software is prohibited without prior written consent from Effectico.
4. Subscription Plans
4.1 Non-Commercial Plan: By default, the user is granted a free Non-commercial plan. Under this plan, created effects can only be used in non-commercial products. Effects exported under this plan will differ from those exported under paid plans, allowing the detection of violations of the Non-commercial plan terms.
4.2 Professional Plan: To develop effects for commercial products, the user must switch to the Professional plan, which requires a monthly subscription. The Professional plan allows for adding sub-accounts for employees.
4.3 Custom Plans: For large companies (more than 20 developer-users), there is an option to create custom contract plans, which are negotiated individually.
5. Export Process
During the export process, all effects are sent from the editor to our remote server, and the exported effects are then stored locally on the user’s disk.
6. Ownership of Effects
Exported effects are the property of the user and can be used as desired, provided it does not violate the terms of the plan under which the effects were exported.
7. Data Privacy
7.1 Data Storage: We do not store or analyze the effects or export results sent to the server. Only the fact of export by a specific user is stored.
7.2 Confidentiality of Materials: All materials submitted by the user are considered confidential and will not be disclosed.
8. Personal Data
Users may set their name and surname and upload a photo on the website. These data do not have to be real, and they are not disclosed or analyzed. This option is provided solely for convenience in communication on the site.
9. Service Restoration
In case of service failure, we guarantee its restoration within less than 12 hours.
10. Changes to the Agreement
Effectico reserves the right to change the terms of this Agreement at any time by notifying you on our website.
11. Force Majeure
Neither party shall be liable for any delay or failure in performance due to causes beyond their reasonable control, including but not limited to acts of God, war, civil disturbances, strikes, lockouts, labor disputes, fires, floods, earthquakes, storms, acts of terrorism, power failures, internet disruptions, governmental actions, or any other force majeure event. If such an event occurs, the affected party shall notify the other party and make reasonable efforts to resume performance as soon as practicable.
This Agreement is governed by the laws of Estonia. All disputes arising from this Agreement shall be resolved in the courts of Estonia.
